These Terms of Use ("Terms") govern your use of silverkingproject.org (the "Site") and any donation you make through the Site. The Site is operated by The Silver King Project, Inc. ("SKP," "we," "us," or "our"), a Delaware nonprofit corporation. By using the Site or making a donation, you agree to these Terms.
SKP is a Delaware nonprofit corporation that provides fully funded saltwater fly fishing programs in the Florida Keys for veterans, active-duty military personnel, and first responders, at no cost to participants.
SKP is recognized by the Internal Revenue Service as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code. Contributions are tax-deductible to the extent permitted by law. EIN 42-3695865.
Donations made through the Site are voluntary charitable contributions. Donations are generally non-refundable. If something has gone wrong — a duplicate charge, an incorrect amount, or a gift made in error — contact us and we will work with you to correct it.
Giving levels shown on the Site describe the approximate cost of the impact identified. Contributions are used to advance our charitable mission, which includes both the direct costs of our programs and the operational costs necessary to deliver them. Unless a gift is subject to a written restriction accepted by SKP, all donations are unrestricted and are applied where they are most needed to carry out our mission.
SKP welcomes recommendations of prospective participants from donors and others, and those recommendations receive genuine consideration — many of the people we serve will come to us this way. All participants are selected by SKP in its sole discretion, in accordance with SKP's eligibility criteria and selection process. A donation does not entitle any donor to select, designate, or guarantee participation by any individual, and selection is never influenced by whether or how much a person has given.
If you elect to make a recurring donation, you authorize SKP, through its payment processor, to charge your selected payment method on the schedule you choose in the amount you select, until you cancel.
Donations are processed by Stripe, Inc. Payment card and bank account information is provided directly to Stripe and is not received or stored by SKP. Your use of the payment process is also subject to Stripe's terms and privacy policy. SKP is not responsible for the acts or omissions of the payment processor.
Donors may be recognized publicly on our Founding Sponsors page using the name or display name provided at the time of the gift. Donors may elect anonymous recognition at the time of the gift. Recognition is provided at SKP's discretion and does not constitute consideration for a gift.
These Terms govern only your use of the Site and any donation you make. Participation in any SKP program or trip is governed by separate written agreements, which may include a participant liability waiver and assumption of risk, a health questionnaire, and a media release. SKP's programs are professionally photographed and filmed, and participants are asked about photography and filming before accepting a place on a trip. Nothing in these Terms grants any right to participate in any SKP program.
You agree not to use the Site to violate any law, interfere with its operation or security, attempt unauthorized access, or misrepresent your identity.
The content of the Site, including text, photographs, graphics, and the SKP name and marks, is owned by SKP or used with permission, and may not be used without our written consent, except as permitted by law.
The Site may link to third-party websites. We are not responsible for the content or practices of those sites.
The Site is provided "as is" and "as available." To the fullest extent permitted by law, SKP disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any defect will be corrected.
To the fullest extent permitted by law, SKP and its directors, officers, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Site or any donation made through it, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.
To the fullest extent permitted by law, SKP's total aggregate liability arising out of or relating to your use of the Site or any donation made through it will not exceed the amount of the donation giving rise to the claim.
This Section applies only to your use of the Site and to donations made through it. It does not apply to, limit, or modify the liability provisions of any separate agreement governing participation in an SKP program, including any participant waiver and assumption of risk.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
You agree to indemnify and hold harmless SKP and its directors, officers, employees, volunteers, and agents from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.
We may modify these Terms at any time. Changes are effective when posted to the Site with a revised Effective Date. Your continued use of the Site after changes are posted constitutes acceptance.
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Charleston County, South Carolina, and you consent to the personal jurisdiction of those courts.
Nothing in this Section limits SKP's ability to seek injunctive or equitable relief in any court of competent jurisdiction.
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
